General provisions

1. The Main Department of Architecture and Urban Planning of the Moscow Region (hereinafter referred to as the Main Department) is the central executive body of state power of the Moscow Region of special competence, carrying out executive and administrative activities in the Moscow Region in the fields of architecture and certain areas of urban planning, implementing state policy in these areas .

Goals and main tasks of the Main Department

10. The Main Directorate was established to implement the state policy of the Moscow Region in the areas of architecture and certain areas of urban planning activities in the Moscow Region.

11. The main tasks of the Main Directorate are:

providing urban planning tools for the spatial development policy of the Moscow Region and creating conditions for sustainable urban development, improving the quality of life of the population, growing the economy of the Moscow Region, to create modern social, industrial, engineering and transport infrastructures;

formation of a modern architectural image of the integrated development of cities, settlements and other settlements, natural and landscape environment, including ensuring the preservation of cultural heritage in the interests of current and future generations;

creation of conditions for the effective functioning of organizations under the departmental subordination of the Main Directorate.

20. The Main Directorate, within its competence, participates in the prescribed manner in carrying out verification activities in relation to public civil servants of the Moscow Region, who are in the state civil service of the Moscow Region in the Main Directorate, and who are admitted to state secrets.

21. The Main Directorate implements the measures provided for by law to restrict the rights of public civil servants of the Moscow Region, who are in the civil service of the Moscow Region in the Main Directorate, and provides social guarantees to persons who have or had access to information constituting a state secret.

22. The Main Department, in accordance with the legislation of the Moscow Region, forms proposals on the volume, range and projected cost of purchased goods, works, services to ensure the activities of the Main Department, as well as on financial support for these purchases at the expense of the budget of the Moscow Region and extrabudgetary funds.

23. 26. The Main Department may be renamed, reorganized or abolished in accordance with the legislation of the Russian Federation and the legislation of the Moscow Region.

The Department of Urban Development and Architecture is a structural subdivision of the Ministry of Construction, Housing and Communal Services of the Russian Federation.

decides:

1. Approve the Regulations on the Committee for Architecture and Urban Planning of the city of Moscow (appendix).

2. Recognize as invalid:

Application. Regulations on the Committee for Architecture and Urban Planning of the City of Moscow

I. General provisions

1. The Committee for Architecture and Urban Planning of the city of Moscow (hereinafter referred to as the Committee) is a sectoral executive body of the city of Moscow, which performs the functions of implementing state policy in the field of ensuring the development of the territory of the city of Moscow in terms of urban planning, including territorial planning, urban zoning, territory planning, as well as in the field of architecture and the formation of the architectural and artistic appearance of the city of Moscow (hereinafter the established scope of activity), and structurally included in the Complex of Urban Planning Policy and Construction of the City of Moscow.

2. The Committee carries out its activities in accordance with the Constitution of the Russian Federation, international treaties, federal constitutional and federal laws, decrees and orders of the President of the Russian Federation, decrees and orders of the Government of the Russian Federation, the Charter of the city of Moscow, laws of the city of Moscow, other legal acts of the city of Moscow and by this Regulation.

3. The Committee carries out its activities in cooperation with federal state authorities, state authorities of the city of Moscow, state authorities of the constituent entities of the Russian Federation, local authorities, public associations of citizens and other organizations.

II. Powers of the Committee

4. The Committee exercises the following powers in the established area of ​​activity:

4.1. Develops and submits, in accordance with the established procedure, for consideration by the Mayor of Moscow and the Government of Moscow, draft legal acts of the Mayor of Moscow and the Government of Moscow on issues related to the established scope of the Committee's activities, including:

4.1.3. On territorial and branch schemes.

4.1.5. On the standards of urban planning in the city of Moscow.

4.2. On the basis of and in pursuance of federal laws and other regulatory legal acts of the Russian Federation, the Charter of the city of Moscow, the laws of the city of Moscow, other legal acts of the city of Moscow makes decisions:

4.2.1. On the preparation and issuance in accordance with the established procedure of urban planning plans for land plots, with the exception of urban planning plans for land plots, prepared in relation to land plots located within the boundaries of the territory of the Troitsk urban district of the city of Moscow and the urban district of Shcherbinka of the city of Moscow.

III. Rights, organization of activities and management of the executive authority of the city of Moscow

5. In order to exercise its powers, the Committee has the right to:

5.7. Monitor, analyze and forecast the implementation of state policy in the established field of activity.

5.8. Exercise other rights in accordance with federal laws and other regulatory legal acts of the Russian Federation, the laws of the city of Moscow and other legal acts of the city of Moscow.

6. The Committee ensures the activities of the Architectural Council of the city of Moscow and the Public Council under the Mayor of Moscow on the problems of urban planning and architectural and artistic formation of the image of the city of Moscow.

6(1). The Committee provides technical, informational, organizational support for the activities of the City Commission on Urban Planning, Land Use and Development under the Government of Moscow.

7. 10. The Committee acts in accordance with the established procedure as a state customer when placing orders for the supply of goods, performance of work, provision of services in the established field of activity.

10(1). The Committee ensures the preparation of land surveying projects in the form of separate documents:

1) to determine the location of the boundaries of the formed and changeable land plots intended for the placement of objects of regional significance and (or) capital construction objects, the design, construction and (or) reconstruction of which are provided for by the targeted investment program of the city of Moscow, if the placement of these objects does not require the withdrawal of land plots and (or) real estate objects located on them for state needs;

2) to establish, change, cancel red lines for built-up areas within whose boundaries it is not planned to place new capital construction facilities, as well as to establish, change, cancel red lines in connection with the formation and (or) change of a land plot located within the boundaries territory, in relation to which it is not envisaged to carry out activities for the integrated and sustainable development of the territory, provided that such establishment, change, cancellation entail only a change in the boundaries of the territory of common use, if there is an appropriate decision of the Urban Planning and Land Commission of the city of Moscow;

10(2). The Committee ensures the preparation and submission of applications for the establishment, change or termination of the existence of sanitary protection zones (including indicative, calculated (preliminary) sanitary protection zones) and documents provided for by the regulation on sanitary protection zones approved by the Government of the Russian Federation, in public authorities authorized to make decisions on the establishment of sanitary protection zones, in the following cases:

10(2). 1. If within the boundaries of the specified sanitary protection zones there are land plots owned by the city of Moscow or state ownership of which is not delimited, the rights to which are planned to be sold at auction, and (or) land plots intended for placement of objects of regional significance and ( or) objects, design, construction and (or) reconstruction of which are provided for by the targeted investment program of the city of Moscow, and (or) capital construction objects necessary for the implementation of the Housing Renovation Program in the city of Moscow.

10(2). 2. If it is necessary to reduce the size of these sanitary protection zones, terminate their existence and (or) terminate certain restrictions on the use of land plots located within the boundaries of such zones, in the absence of relevant applications from the right holders of capital construction projects.

11. The Committee, within the established scope of activities, takes measures to implement state programs of the city of Moscow, as well as to implement programs, projects and activities in the field of energy conservation and energy efficiency.

12. The Committee protects the interests of the city of Moscow in the established area of ​​activity in courts, arbitration courts, arbitration courts, federal executive bodies exercising control (supervision), represents the Government of Moscow in other state bodies and organizations in the prescribed manner.

13. The Committee organizes and carries out, within its competence, mobilization training and mobilization in the manner prescribed by federal laws, other regulatory legal acts of the Russian Federation, laws of the city of Moscow, and other legal acts of the city of Moscow.

18. Chairman of the Committee:
